These Terms and Conditions govern all use of the website www.alayafitness.com and all purchases made through it.
They apply to both private individuals (B2C) and professional clients (B2B).
By accessing the website or placing an order, the customer agrees to these Terms without reservation.
ALAYA fitness reserves the right to update these Terms at any time.

3. Products
ALAYA fitness offers Pilates equipment including reformers and accessories.
Certain products are customizable. Specifications (colors, finishes, materials, configurations) are defined with the customer prior to production.
Product visuals and descriptions are indicative and may vary slightly.

4. Orders & Quotations
Orders may be placed directly online or via quotation.
For customized or professional projects, a quotation must be approved before production begins.
ALAYA fitness reserves the right to refuse or cancel any order in case of:
- non-payment
- dispute
- suspected fraud

5. Pricing & Taxes
Prices are indicated in euros (€), unless otherwise stated.
Depending on the destination:
- VAT may be included or excluded
- Customs duties and local taxes may apply
The customer is responsible for any import duties unless explicitly stated otherwise.
ALAYA fitness reserves the right to modify prices at any time.

6. Payment
Payment terms depend on the order:
- Full payment for standard products
- Deposit + balance for custom or large orders
Orders are processed only after payment confirmation.

7. Quotations & Deposits
For customized or large orders, a deposit may be required.
Deposits are non-refundable once production has started.
The remaining balance must be paid before shipment unless otherwise agreed.

8. Production & Custom Orders
Customized products are made according to customer specifications.
Once production has started:
- Orders cannot be modified
- Orders cannot be cancelled
- No refund will be issued except in case of proven defect

9. Delivery
Delivery is made to the address provided by the customer.
The customer is responsible for:
- providing accurate delivery information
- ensuring availability at delivery
- ensuring the location is accessible for large and heavy goods
ALAYA fitness is not responsible for delivery failure due to:
- absence of the customer
- incorrect information
- difficult access (stairs, narrow entrances, etc.)
Delivery is considered completed once the goods are made available at the delivery address.
The customer must inspect the goods upon delivery and report any damage within 48 hours.
In case of failed delivery attempts:
- Additional shipping, storage or redelivery fees will be charged
- The customer must arrange a new delivery
If the customer is unavailable after at least two delivery attempts or fails to organize redelivery:
The order may be considered abandoned and no refund will be issued.
If goods are returned to ALAYA fitness, return shipping and handling costs will be charged.

10. Transfer of Risk
The risk of loss or damage transfers to the customer upon delivery.
For B2B transactions, risk may transfer upon handover to the carrier.

11. Installation
Unless explicitly agreed otherwise, delivery does not include installation.
The customer is responsible for installation and proper use.
ALAYA fitness is not liable for damage resulting from improper installation or misuse.

12. Returns & Withdrawal
For non-customized products (B2C only):
Customers may benefit from a 14-day withdrawal period under EU law.
Products must be returned:
- unused
- in original condition
- in original packaging
Return shipping costs are borne by the customer.
For customized or made-to-order products:
No returns or refunds are accepted except in case of defect.
B2B customers are not entitled to a withdrawal right unless agreed otherwise.

13. Warranty
Products are covered by a legal warranty against manufacturing defects.
The warranty does not cover:
- normal wear and tear
- misuse
- incorrect installation

14. Liability
ALAYA fitness shall not be held liable for:
- indirect damages
- loss of use
- business interruption

The total liability of ALAYA fitness shall be limited to the amount paid for the order.

ALAYA fitness shall not be held liable for delays or failure due to events beyond its control, including:
- transport disruptions
- supply chain issues
- strikes
- natural events
- customs delays
Delivery times may be extended accordingly.
